Senate Bill No. 53 CHAPTER 138

Legislation State lawNorthern America · USadopted

This California statute enacts the Transparency in Frontier Artificial Intelligence Act (TFAIA), which requires large frontier developers of advanced foundation models to adopt and publish frontier AI frameworks, report critical safety incidents and catastrophic risk assessments to the Office of Emergency Services, and comply with civil penalties for noncompliance. It also establishes a consortium within the Government Operations Agency to develop a framework for a public cloud computing cluster known as CalCompute, and introduces whistleblower protections for covered employees reporting catastrophic risks or violations.

What the document contains

What's covered

The document covers mandatory governance, transparency reports, and catastrophic risk assessments for large developers of frontier AI models. It establishes reporting mechanisms for critical safety incidents through the Office of Emergency Services, creates a framework for a public cloud computing cluster (CalCompute), and outlines comprehensive whistleblower protections and enforcement mechanisms.

What's missing

The text does not apply to developers whose computing power falls below the specified frontier threshold, nor does it regulate smaller companies outside the frontier until future legislation is enacted.

Key takeaways
  • Large frontier developers of foundation models trained using computing power greater than 10^26 operations must write, implement, and publish a frontier AI framework addressing catastrophic risk management.
  • Frontier developers are required to report critical safety incidents to the Office of Emergency Services within 15 days, or within 24 hours if there is an imminent risk of death or serious physical injury.
  • The legislation establishes a consortium to develop a framework for a public cloud computing cluster called CalCompute to advance safe, ethical, and equitable artificial intelligence.
  • Robust whistleblower protections are established to protect covered employees who disclose specific and substantial dangers to public health and safety or violations of the TFAIA.
  • Noncompliance with the Transparency in Frontier Artificial Intelligence Act is subject to civil penalties enforced exclusively by the Attorney General.
Principles it states
Balancing technology benefits and the potential for material risks in artificial intelligencePromoting transparency, accountability, competition, and public trustEnsuring that advanced artificial intelligence systems are developed and deployed with due care proportional to foreseeable risks
